The Fair Housing Act

Title VIII of the Civil Rights Act of 1968, as amended, prohibits discrimination in the sale, rental, and financing of housing based on race, color, national origin, religion, sex, familial status, and disability. The law covers most housing.

It is illegal to discriminate in the sale or rental of housing, including:

• Refusing to rent or sell housing
• Refusing to negotiate for housing
• Making housing unavailable
• Denying a dwelling
• Setting different terms, conditions, or privileges for sale or rental of a dwelling
• Providing different housing services or facilities
• Falsely denying that housing is available for inspection, sale, or rental
• Persuading owners to sell or rent (blockbusting)
• Denying anyone access to or membership in a facility or service related to the sale or rental of housing

In mortgage lending, it is illegal to:

• Refuse to make a mortgage loan
• Refuse to provide information regarding loans
• Impose different terms or conditions on a loan
• Discriminate in appraising property
• Refuse to purchase a loan
• Set different terms or conditions for purchasing a loan
